Learn what copyright licences ACU has, to use copyright material and under what conditions.

ACU has purchased several copyright licences that enable ACU as an educational institution to use third-party material without requiring permission for every use. These blanket licences reduce administrative burden on all staff to undertake teaching and university activities.

Here we outline the rights and obligations available to ACU staff under the licences. Contact the Copyright Manager at copyright.officer@acu.edu.au for training on the full breadth of the licences.

ACU has 2 statutory licences and 2 voluntary licences.

CA 113P statutory licence

Under section 113P of the Copyright Act 1968, ACU has a signed contract with the Copyright Agency to allow the copying of literary, dramatic, musical and artistic (images) works for educational purposes and also communicate those works to students.

All literary, dramatic, musical and artistic (images) works must come from a legal original (for example, downloaded off the internet, out of a print book, or you have subscribed to a service).

Rights

The licence allows ACU to copy and communicate text and artistic works in both hard copy (handouts in class) and electronic form (on Canvas), including:

  • PowerPoints with text (quotes) or artistic (image/photograph/diagram) material being presented to a class of students
  • PowerPoints with text (quotes) or artistic (image/photograph/diagram) material being recorded in lecture capture
  • scanning or photographing from hardcopy books, journals, newspapers, PDF’s, or reports and providing to students in Leganto
  • saving extracts from electronic material such as websites, ebooks or CD-ROMs and providing to students in Leganto
  • photocopying hardcopy books, journals, newspapers or reports and providing to students in class
  • printing from electronic material such as websites, ebooks or CD-ROMs and providing to students in class.

Obligations

There are limits on how much can be copied under this licence.

  • Literary material – 1 chapter available to students per teaching period (calendar based). When written material is broken up into chapters identifiable by having titles or distinctive headings or identified on the contents page. This does not include anthologies each work is considered a separate work. Computer programs are excluded from the licence. Contact the Library for clarification around chapters. Copy must be in Leganto.
  • Literary material – 10 percent of a work available to students per teaching period (calendar based). When a written work clearly does not have chapters, then 10% of the work can be used, this can be 10% of the pages (calculated from page one to last numbered page), or 10% of the number of words in the work. Computer programs are excluded from the licence. Contact the Library for clarification around 10%. Copy must be in Leganto.
  • Literary material – an entire journal article can be copied and made available to students per teaching period (calendar based) from a single edition of the periodical publication. Additional articles may be available from a single edition, if the edition is a special ‘focus’ edition. Contact the Library to discuss. Copy must be in Leganto.
  • Literary material – an entire publication maybe copied if the work is out of print (not available in paper or online/digital). A record of investigation is required. Contact Library for assistance. Copy must be in Leganto.
  • Artistic material – images /photographs /diagrams /paintings. An entire image can be copied and placed either in a PowerPoint or in Leganto.
  • Dramatic material – scripts / theatre plays / written choreography. Copying limits are the same as literary material.
  • Musical material – musical notation copyright limits are the same as literary material.

The copied source material must acknowledged. For example a:

  • Leganto citation
  • citation list or bibliography
  • credits list at the end of a video
  • verbal thanks at the end of a recital or music program
  • reference slide at the end of a PowerPoint presentation
  • clickable link under the image.

Include required legal notice.

Screenrights 113P statutory licence

Under section 113P of the Copyright Act 1968, ACU has a signed contract with Screenrights to allow the copying of radio and television broadcast material for educational purposes and also communicate those works to students.

All broadcast recordings must come from a legal original (for example downloaded from a broadcaster’s website, recorded from the broadcast or through a broadcast supplier).

Rights

The licence allows ACU to copy and communicate broadcast works in both hard copy (DVDs) and electronic form (digital file in Canvas), including:

  • playing a broadcast through ClickView (a Screenrights broadcast supplier) to a class
  • playing a broadcast through ClickView in a recorded lecture
  • making a broadcast from ClickView available to students in Leganto
  • downloading a radio podcast and make it available to students in Leganto
  • recording a free-to-air television show and making it available to students in Leganto
  • recording a free-to-air radio show and making it available to students in Leganto
  • recording a Foxtel show and making it available to students in Leganto.

Obligations

The copied source material must acknowledged. For example a:

  • Leganto citation
  • citation list or bibliography
  • credits list at the end of a video
  • verbal thanks at the end of a recital or music program
  • reference slide at the end of a PowerPoint presentation
  • clickable link under the image.

APRA/AMCOS ARIA/PPCA music licence

ACU purchases a music copyright licence which enables us to use many contemporary musical sound recordings.

All sound recordings must come from a legal original (for example downloaded from a legal online provider or copied from a legal CD recording).

Rights

The licence allows ACU to copy and communicate music sound recordings for educational purposes and for some professional university uses, including:

  • playing music to a class
  • playing music in a recorded lecture
  • making a sound recording available to students in Leganto
  • playing music at university public events like open day, graduation, welcomes, or NAIDOC
  • playing music at university staff events like Christmas parties, morning teas or presentations.

Music can also be recorded as ‘background music’ when undertaking some university activities including:

  • streaming of university events on ACU websites or social media channels
  • recording university events and making it available to staff and students behind password protected ACU areas or can be sold as CDs, DVDs on a cost recovery basis only.

Obligations

The sound recording source material must acknowledged. For example a:

  • Leganto citation
  • citation list or bibliography
  • credits list at the end of a video
  • verbal thanks at the end of a recital or music program
  • reference slide at the end of a PowerPoint presentation
  • clickable link under the image.

One License music licence

The One License music licence enables ACU to use hymns, songs and service music as worship aids for service hymnals, bulletins and projections to inspire congregational singing.

Rights

The licence allows ACU to copy and make available during religious activities hymns both music and lyrics, including:

  • copying selected music and lyrics into a hymnal for congregational use
  • copying selected music and lyrics onto a page for special activity like a wedding
  • projecting selected music and lyrics onto a wall for congregational use.

Obligations

The music and lyrics must acknowledged. For example:
